Terms Of Service
These Terms of Service ("Terms") govern your use of BooSend, operated by MENTOR AI LLC ("we," "us," "our"). By accessing or using our social media automation platform (Instagram, Facebook, WhatsApp, Telegram) and related services, you agree to be bound by these Terms. Please read them carefully.
Section 1: Acceptance of Terms
By signing up, logging in, or otherwise using BooSend ("we," "us," "our"), you ("you," "your") agree to be legally bound by these Terms of Service ("Terms"). These Terms govern your use of BooSend's website, app, messaging tools, automation features, and any related services (collectively the "Service"). If you do not agree, do not use the Service.
BooSend is owned and operated by MENTOR AI LLC, which oversees the infrastructure, data handling, and maintenance of the platform.
Section 2: Account, Password & Eligibility
- You must be at least 16 years old to use BooSend, or the legal age of majority in your jurisdiction.
- You are responsible for keeping your login credentials secure. You accept all activity under your account.
- Immediately notify us of any unauthorized access or suspected breach.
Section 3: Authentication & Permissions
Instagram, Facebook & WhatsApp Authorization
You grant BooSend permission, via Meta's official authentication flow, to access and manage messages, trigger automations, and send messages on your behalf. Authentication is securely handled by Meta, and BooSend does not request or store your password directly.
Telegram Authorization
You authorize BooSend on Telegram using your Bot Token. This allows BooSend to manage messages and automations through your Telegram bot. You can revoke access at any time through the Telegram tab of BooSend's platform. BooSend does not request or store your personal Telegram account credentials.
Scope of Permissions
BooSend automations are triggered only based on actions such as comments, DMs, or story replies. We comply with Meta's platform rules. Sending bulk, unsolicited messages, scraping data, or automating follow/unfollow actions is strictly prohibited.
Section 4: Prohibited Use
You agree not to use BooSend to:
- Violate any law or third-party rights
- Automate activity that goes against Meta's platform rules
- Send spam, unsolicited messages, or engage in harassment
- Use the service for illegal activities or fraud
- Attempt to reverse engineer or hack our systems
- Share your account with unauthorized parties
Section 5: Service Availability & Third-Party Dependencies
BooSend strives for high uptime but cannot guarantee 100% availability. We may perform maintenance, updates, or modifications that temporarily affect service access.
Third-Party Platform Dependencies
BooSend relies on third-party platforms (Meta/Instagram, Facebook, WhatsApp, Telegram) for event delivery (e.g., webhooks). These platforms do not guarantee real-time delivery, completeness, or uninterrupted availability. Delays, duplicates, or missing events may occur.
BooSend is not responsible for outages, rate limits, policy changes, enforcement actions, or delivery failures caused by Meta/Instagram or other third-party services.
Best-Effort Processing
We process events on a best-effort basis and may use fallback methods (e.g., polling where permitted), but we do not guarantee that every message or event will be captured or acted upon.
Section 6: Data & Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using BooSend, you consent to our data practices as outlined in our Privacy Policy.
Section 7: Limitation of Liability
BooSend is provided "as is" without warranties. We are not liable for any damages arising from your use of the service, including but not limited to account suspensions, lost data, or business losses.
Section 8: Termination
Either party may terminate this agreement at any time. Upon termination, your access to BooSend will cease, and any outstanding obligations remain in effect.
Refund Policy
All BooSend subscription plans are non-refundable. Once a subscription payment has been processed, it will not be reversed or credited back under standard circumstances.
AI credits purchased through BooSend are also non-refundable. All credit purchases are final and cannot be exchanged, transferred, or refunded once added to your account.
In rare and exceptional cases, a refund may be considered if special circumstances apply. Any such refund is granted solely at the discretion of MENTOR AI LLC and is not guaranteed. To request a review, contact us at team@boosend.ai.
Section 9: Changes to Terms
We may update these Terms from time to time. Continued use of BooSend after changes constitutes acceptance of the new terms.
